AP Teachers Transfers 2022 Guidelines & Norms BY CSE

School Education – Ensuring of subject teachers in the High Schools and required number of teachers in Foundational Schools, Foundational School Plus – AP Teachers (Regulation of Transfers) Guidelines, 2022 – Certain instructions issued – Govt. Orders Communicated – Regarding Rc.No.ESE02-14/11/2022-EST4-CSE-Part(1)  Dt:10.12.2022

ORDER:

The attention of all Regional Joint Directors of School Education and District Educational Officers in the State is invited to the reference read above, wherein the Government has issued detailed guidelines for the transfer of Headmasters (Gr.II), School Assistants (SAs), and equivalent cadres, Secondary Grade Teachers (SGTs) and equivalent categories working in Government, Zilla Praja Parishad and Mandal Praja Parishad Schools in the State during Academic Year 2022-23. A Copy of the Government Order is herewith communicated.

In earlier teacher transfers (i.e, 2020), several court cases have been filed by the Headmasters/Teachers in the Hon’ble High Court of A.P on various aspects i.e., old station points, re-apportionment points, cutoff date, vacancies, misuse of spouse points,etc. Keeping in view of past experience, all Regional Joint Directors of School Education and District Educational Officers in the State are requested to strictly follow/ensure the below guidelines along with the clear guidelines issued by the Government vide reference read above.

  1. Erstwhile Districts shall be taken as District as a Unit for transfers.
  2. Those Headmasters (Gr.II) who have completed 5 Academic years of service and those Teachers who have completed 8 Academic years of service in a particular school by Academic Year 2021-22 shall be transferred compulsorily.(i.e., who joined before 02.11.2017 in case of Headmasters (Gr.II) and 02.11.2014 in the case of Teachers)
  3. No minimum service is required for applying request transfer.
  4. Headmaster (Gr.II) teacher shall apply for transfers per the schedule specified in the G.O. No Headmaster (Gr.II) /Teacher is allowed to apply multiple times online.
  5. Headmasters (Gr.II)/Teachers, where the preferential categories are claimed on health grounds shall submit the latest medical reports as certified by the District Medical Board to the Committee. The Committee shall verify the reports in detail and genuine cases shall be authenticated for consideration of the respective claim.
  6. Headmasters (Gr.II)/Teachers shall ensure that, one of the spouse shall only claim extra points under the spouse category duly following the norms as envisaged in guidelines issued by the However, validation will be ensured in the Transfer module.
  7. The Committees shall constitute a sub-committee for verification of all spouse cases and instruct the sub-committee to verify all spouse cases in detail along the options exercised by the individual (in accordance with rules or not) before submission of the final list and furnish a declaration that spouses are opted vacancies as per rules.
  8. If any misuse of spouse points is noticed, appropriate disciplinary action will be initiated against the individual as per rule 20 of CCA rules and a major penalty of withholding three increments with cumulative effect shall be imposed besides filing a criminal case. The Grievances regarding opting for places with spouse points shall not be entertained.
  9. The Headmaster (Gr-II)/Teacher should avail of either the preferential category (Guideline 8) or the special points {Guideline 6 (i to iv)} once in 5/8 years respectively and an entry is to be made in his/her Service Register and the same shall be certified by the DDO concerned.

The following vacancies shall be notified for counseling:

  • All clear vacancies as on 30.11.2022
  • All vacancies arising due to compulsory transfers as per guideline 2
  • Resultant vacancies arise during counseling (i.e., promotions, transfers, etc.,).
  • Headmaster (Gr.II)/Teachers who have promoted and allotted places on Adhoc basis as per this office Procgs Dt:14.10.2021, their places are to be shown as vacant.
  • Vacancies existing due to authorized/unauthorized absence of teachers for more than 1 year.
  • Vacancies due to maternity leave, medical leave, or under suspension should not be notified. They can be filled up by work adjustment if the period is beyond 4 weeks.
  • The committee shall arrive at the number of vacancies i.e. the difference between sanctioned and working in each cadre. Then the committee shall have to block the same number of vacancies proportionately in categories I, II, and III taking Mandal as a unit.

Example: In an erstwhile district, sanctioned SGT posts: 5,000 and working: 4500, then to be blocked vacancies are 5000­4500=500. If 40 mandals in the district, proportionately block those 500 vacancies in category-I, II, and III.

  • RJDSEs/DEOs shall display the vacancies/seniority list and dispose of the objections / grievances of the Headmasters (Gr.II)/Teachers strictly as per the schedule specified in the G.O.
  • If any teacher in the DEO’s pool should be shown at the actual school from where he/she is drawing salaries, for enabling them to apply for a transfer.
  • Manual counseling should be taken up within the trades in respect of Vocational Instructors/Art/Craft/Drawing/WI/MTI/Music etc.,
  • PETs who are working against the SA PE post shall not be disturbed until and unless they come under compulsory transfer or they apply for request transfer, such PETs shall be allowed to opt the vacant PET post only. If there are no PET posts in the erstwhile district, such PETs will be allowed to opt for the SA PE posts in the leftover vacancies.
  • No teacher should be kept in DEO Pool.
  • A District Grievance Redressal Cell for Transfers 2022 shall be established at erstwhile districts with the staff (technical & domain knowledge) of both erstwhile district and new district for redressal of all types of grievances related to Teacher Transfers, 2022 and they shall be in continuous coordination with the IT cell of this (All DEOs shall share the details of staff along with phone nos of the employees drafted for District Grievance Redressal Cell to the undersigned).
  • If any teacher dealing with NCC/Scouts units is transferred and not replaced with any teacher dealing with the same unit of NCC/Scouts, necessary arrangements will be made for completing the students’ course dealt for this Academic Year.
  • Headmaster (Gr.II)/Teacher who rendered their services in a particular school continuously irrespective of cadres shall be counted their service from the date of joining in that particular
  • All vacancies once displayed on the website can’t be deleted/added in any manner. If any such discrepancy is noticed by the undersigned at any time, severe action will be initiated against the concerned officials (RJDSE/DEO/AD/ASO/APOs etc.,)

    Further, the Director, Co-ordination is requested to depute one Liaison Assistant at O/o Government Pleader for Education/Services, Hon’ble High Court of A.P particularly to appraise the writ petitions filed/case status/counter affidavits/instructions relating to the teacher transfers (2022) and he should be in continuation co-ordination with the JD/AD Services-II/Estt.IV section and field-level functionaries for prompt and timely action to avoid legal complications if any. The RJDSEs and DEOs in the State are requested to coordinate with the legal cell of this office duly appraising the writ petitions filed/case status/counter affidavits/instructions relating to the teacher transfers (2022) without delay for quick disposal.

    The IT cell of this office is directed to validate all spouse cases in detail along with the options exercised by the individual in accordance with rules with appropriate mechanisms and transfer counseling for PETs shall run only after SA PE transfers in the matter.


    Therefore, all Regional Joint Director of School Education and District Educational Officers in the State shall strictly adhere to the transfer guidelines and schedule scrupulously for smooth conduct of Transfer Counselling. The Special Officers appointed for each district shall closely monitor the entire transfer counseling process duly submitting the compliance to the undersigned from time to time.


    If any deviation in this regard, necessary action will be initiated as per the rules in vogue.
