Sub: Finance Department- Public Services – Enhancement of the age of superannuation from (60) years to (62) years – Applicability – Certain Instructions – Reg.

Ref: G.O.Ms.No.15, Finance (HR.IV-FR&LR) Department dated 31.01.2022 read with Andhra Pradesh Public Employment (Regulation of Age of Superannuation) (Amendment) Act 4of 2022.

Th e Govern men t h ave t aken a decis ion t o en h an c e t h e age of superannuation from (60) years to (62) years in respect of the State Government employees covered under the Andhra Pradesh Public Employment (Regulation of Age of Superannuation) Act, 1984, w.e.f.01.01.2022.

  1. Accordingly, orders were issued vide the G.O.Ms.No.15, Finance (HR IV-FR&LR) Department, dated 31.01.2022 read with the Andhra Pradesh Public Employment (Regulation of Age of Superannuation) (Amendment) Act, 2022 (Act4 of 2022).

  2. The AP State Legislature has approved the amendment to the Andhra Pradesh Public Employment (Regulation of Age of Superannuation) (Amendment) Act, 2014 (Act 4 of 2014) published in A.P. Extra-ordinary Gazette No.4, dated 19-04.-022 which has come into effect from 01.01.2022.

  3. The provisions of the amendment to the Act are applicable to the following category of employees.

    1. persons appointed to public services and posts in connection with the affairs of the state;

    2. officers and other employees working in any local authority, whose salaries and allowances are paid out of the consolidated fund of the State,

    3. persons appointed to the Secretariat Staff of the Houses of the State Legislature and

      every other officer or employee whose conditions of service are regulated by the rules framed under the proviso to Article 309 of the Constitution of India before the commencement of this Act, other than the Village Officers and Law Officers;

      whether appointed before or after the commencement of this Act.

  4. The G.O. and the amendment to the Act in the reference cited are self explanatory and in respect of the category of employees mentioned therein and there is no scope for any ambiguity or doubt requiring clarification or interpretation.

  5. Notwithstanding the above, it is brought to notice of the Government that certain Government PSUs / Corporations / Institutions / Companies / Societies including Educational Institutions / Non-teaching staff of the Universities have issued orders extending the age of superannuation from (60) to (62) years, without having the necessary competency.

  6. Such action, wherever it has been taken, constitutes a flagrant violation of the established Government procedures & the rules of business. Therefore, immediate remedial action is to be taken without loss of time as per the procedure. Further, disciplinary action against those responsible is to be initiated as per the

    rules, by the concerned competent authority.

  7. In view of the above, the Government hereby clarifies that the orders were issued vide the G.O.Ms.No.15, Finance (HR IV-FR&LR) Department, dated 31.01.2022 read with the Andhra Pradesh Public Employment (Regulation of Age of Superannuation) (Amendment) Act, 2022 (Act 4 of 2022) are applicable in respect of no other category of employee except the following:

    1. persons appointed to public services and posts in connection with the affairs of the state;

    2. officers and other employees working in any local authority, whose salaries and allowances are paid out of the consolidated fund of the State,

    3. persons appointed to the Secretariat Staff of the Houses of the State Legislature and

    4. every other officer or employee whose conditions of service are regulated by the rules framed under the proviso to Article 309 of the Constitution of India before the commencement of this Act, other than the Village Officers and Law Officers;

      whether appointed before or after the commencement of this Act.

  8. The Special Chief Secretary/Principal Secretary/Secretary shall ensure that there are no deviations from the orders issued by the Government in the reference cited in respect of their unit offices take action in terms of these orders wherever

necessary & send the compliance report to the Finance Department latest by

30.09.2022.
